ACCEPTANCE
OF POLICIES THROUGH USE
By using Dluxlink Internet Services,
you signify your agreement to all policies, conditions, and notices contained
or referenced herein. We reserve the right, at our discretion; to update or
revise these policies so please check them regularly for changes. Your
continued use of the service following the posting of any changes to the
policies constitutes acceptance of those changes. This agreement represents the complete
agreement and understanding between Dluxlink Internet Services and Customer and
supercedes any other written or oral agreement.
Dluxlink’s Terms of Service
By paying a fee and using Dluxlink as their
Internet Service Provider (ISP) users are deemed to be in agreement with the
following policies:
1.
Basic PPP users have unlimited Internet access, except as
otherwise noted. Unlimited access is defined as being connected and actively
engaged in legitimate activity.
2.
Users are permitted only ONE simultaneous dial-in. You may use
only ONE of our modem lines at a time unless other arrangements have been
made.
3.
Access to dluxlink.com via Telnet is not permitted. Shell accounts
are not available.
4.
Users may dial into any of our access numbers.
5.
UNSOLICITED MASS EMAIL ("SPAMMING") IS NOT PERMITTED.
Dluxlink users sending unsolicited email to multiple recipients (Dluxlink or
non-Dluxlink addresses) WILL have any and all accounts with Dluxlink
IMMEDIATELY TERMINATED.
6.
Dluxlink reserves the right to terminate or suspend your account
without notice for any activity deemed unreasonable by Management or System
Administration staff. Such activity may include (but is not necessarily limited
to):
a.
Security violation, defined as unauthorized access of this
or any other system using your Dluxlink account, whether proven or strongly
suspected.
b.
Giving your password to someone else. (A user id and password may
be used by one person at a time.)
c.
Harassment of others in the Internet community by email,
newsgroups, IRC, or any other medium using your Dluxlink account.
d.
"Spamming", defined as unsolicited information or
advertisement via newsgroups or email, or propagation of such material, using
your Dluxlink account.
e.
IRC bots, floods, or DCC (sending-receiving of files over IRC)
using any Dluxlink server. Any user account found to be the cause of the
"Dluxlink.com" domain being banned from any IRC channel or host will
be terminated.
f.
Use of unauthorized software from your Dluxlink web page account.
If you are unsure if it is allowed, ask. Use of any program designed to run as
a server (does not require you to be logged in) is prohibited.
g.
Distribution or storage of illegal or pirated software, movies, or
music with/from your Dluxlink account.
h.
Non-payment of user fees, including declined credit cards or
returned checks.
i.
Use of any program designed to hold a connection open while the
user is absent from the computer is prohibited.
7.
Users may cancel at any time, without penalty. Usage fees already
charged for the month are NOT refundable or prorated. Accounts paid for the
year will be refunded at the monthly rate, based on time used.
8.
Violation of any user policy will be handled in the following
manner:
1.
First Violation of any policy: User will be warned via email of
violation, and required to cease such activity immediately.
2.
Second Violation of any policy (not limited to a repeat of the
first violation): User's account access will be suspended. It is the user's
responsibility to contact Dluxlink for remedy. User's account will be
reactivated at the discretion of Dluxlink Management or System Administration
staff. User is still responsible for account fees while account is suspended,
as account suspension is NOT equivalent to cancellation.
3.
Third Violation of any policy (not limited to repeat of the first
two violations): User's account will be permanently terminated.

Violation of the "NO SPAMMING" rule will result in
immediate account termination.
5.
Non-payment of account fees by due date will result in immediate
suspension of account. User is still responsible for fees while account is
suspended, as suspension is NOT equivalent to account cancellation.
9.
Storage for Personal web page accounts is limited to 20 MB
averages per month, and includes your home directory, file. Please call us if
you need additional storage. Dluxlink reserves the right to put a 20 MB quota
on users' accounts that persistently violate the 20 MB limit. If you find that
you consistently require more than 20 MB of storage, consider upgrading your
account to a Business Account, which includes an additional 40 MB of storage,
among other features.
10.
Dluxlink will attempt to provide the highest quality and
reliability of service, but service is not guaranteed. Loss of data or service
due to hardware, software, or other failure does not give the user the right to
compensation, financial or otherwise.
11. All rates and access
policies are subject to change at any time. Users will be given 30 days notice
of change in user fees. Access policies are subject to change without notice,
and take effect upon announcement.
The Dluxlink billing period is one month and the
billing cycle begins on the day the account is activated.
Service payments will be submitted in advance of receiving services. Delinquent
accounts are those that remain unpaid 10 days after invoicing. If an account is
delinquent for 30 days, Dluxlink reserves the right to delete the account and
all associated files. Once deleted, all record and files in your account are
not accessible or recoverable.
Dluxlink will invoice all accounts. You are responsible for remitting payments
to Dluxlink before the next billing cycle to extend your service. Note that if
your account is blocked or deleted due to non-payment and you remit payment
after the due date, the payment will be applied to the past due invoice. The
account will not be credited for the time the account was blocked.
Customer is responsible for all fees up to the date of cancellation of the
services. Notification of cancellation must be received at least 5 business
days before the end of the billing cycle. Accounts can only be cancelled at the
end of the billing cycle; no partial refunds are given. If the account is on
semi annual or annual billing Dluxlink will carry you through the current month
and a refund will be given for the remaining months.
Customer may change the method in which they are
being billed. Notification must be received at least 5 business days before the
end of the current billing cycle.
Dluxlink will charge a $25.00 NSF fee for all
checks or automatic drafts that are returned to us unpaid from the bank. Any
automatic draft that is returned will automatically be switched to paper
billing and an invoice mailed to Customer.
The only person authorized to make changes on
the account is the person whose name is on the account. If Customer would like
to add additional people it must be submitted in written or email form to the
Billing department.
Should someone opening a new account mention
that you referred him or her to us, you are entitled to a $5.00 credit on your
monthly bill. This credit will be posted once the new member has paid their
second month’s bill. Credits can be carried forward to the next billing period,
but cannot be redeemed for cash.
If Customer is going to be gone for a period of
ten days or longer they may contact Dluxlink and have their account put on
hold. This will suspend the billing for that time frame. Billing will restart
once Customer has contacted Dluxlink to reestablish connection.
This agreement shall remain in effect until
Customer terminates his/her account or Dluxlink cancels Customer's account. In
addition, Customer shall notify Dluxlink in writing or by email of any changes
in the account information, such as address or phone number.
